Terms & Conditions

By accessing or using Bodha App or Pivot by Bodha (together, the "Platform"), operated by Bodha Labs Ltd. ("we", "our", "us"), you agree to these Terms & Conditions. Please read them carefully before proceeding.

1. Eligibility & Age Requirement

You must be at least 18 years old to use the Platform. This requirement applies globally and is mandatory under India's Digital Personal Data Protection Act (DPDPA), 2023. By using the Platform you confirm you are 18 or older. If we discover a user is under 18, their account and data will be deleted promptly.

2. Permitted Use

The Platform is provided for educational and career-development purposes only. You may not use it for unlawful, harmful, abusive, or fraudulent activities, or in any way that violates applicable law in your jurisdiction.

3. User Responsibilities

  • Provide accurate information during registration or onboarding.
  • Keep magic-link login credentials and session IDs confidential.
  • Respect other users and mentors in any shared spaces or cohorts.
  • Do not enter personally identifiable information (names, IDs, contact details) of third parties into AI prompt fields.
  • Do not attempt to reverse-engineer, scrape, or disrupt Platform services.

4. AI-Powered Features & Limitations

The Platform uses large language model (LLM) services to generate career insights and guidance. You acknowledge and agree that:

  • AI-generated outputs are informational only and do not constitute professional career, legal, psychological, or financial advice.
  • You are always interacting with an AI system, not a human counsellor. The Platform is transparent about its AI nature in compliance with the EU AI Act (Regulation (EU) 2024/1689).
  • AI responses may be inaccurate, incomplete, or unsuitable for your specific situation. You should apply your own judgement.
  • Your text inputs may be transmitted to third-party AI providers (OpenAI, OpenRouter) as described in our Privacy Policy.
  • We may switch between AI model providers at any time to maintain service quality and manage costs.

5. Intellectual Property

All text, graphics, software, prompts, and platform design belong to Bodha Labs Ltd. or its licensors. You may not copy, reproduce, or redistribute any part of the Platform without our written permission. AI-generated outputs produced using your inputs are provided to you for personal use; we make no copyright claims over content you authored.

6. Data Processing & Privacy

We process your data in accordance with our Privacy & Data Policy, which includes rights and obligations under GDPR (EU/EEA), DPDPA (India), CCPA/CPRA (California), and LGPD (Brazil).

Analytics tools (e.g. Google Analytics) may use cookies as described in our Cookie Policy.

For organisation accounts, the organisation is the data controller for its members' data and Bodha Labs Ltd. acts as a processor under a Data Processing Agreement (DPA). Contact privacy@bodhaapp.com to request a DPA.

7. Liability Disclaimer

The Platform is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, Bodha Labs Ltd. is not liable for any direct, indirect, incidental, or consequential loss or damage arising from use of the service, reliance on AI-generated outputs, or third-party service interruptions.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of the jurisdiction in which Bodha Labs Ltd. is registered. Disputes will first be addressed through good-faith negotiation. If unresolved, disputes may be referred to the competent courts of that jurisdiction, without prejudice to statutory rights available to consumers under local law (including EU consumer protection rules, DPDPA redress mechanisms, California rights, and LGPD ANPD complaints).

Nothing in these Terms limits rights you have under mandatory local consumer or data protection law.

9. Updates to These Terms

We may update these Terms periodically. We will notify registered users of material changes by email or platform notice at least 14 days before they take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.
